A. The shoreline buffer is described in Table 3.2 and illustrated in the shoreline buffer map in Appendix A. The locations of the buffer boundaries identified on the shoreline buffer map are approximate. The edge of the shoreline buffer shall be determined by the town upon submittal of a completed application.

B. The dimensional shoreline buffers are measured on a horizontal plane starting at the OHWM and moving landward in a perpendicular angle to the South Prairie Creek.

C. The shoreline buffer that terminates at the top of the slope also begins at the OHWM and extends to the point at which the grade level changes from angled to horizontal, or at the upper edge of the hill running down to the creek.

D. If disagreement develops as to the exact location of the shoreline buffer boundary line, the following rules shall apply:

1. Boundaries indicated as approximately following lot, tract, or section lines shall be so construed. Where boundary line adjustments or other modifications are not indicated on the shoreline buffer map and where the adjustments involve two different buffer widths, the most environmentally protective shall apply.

2. Boundaries indicated as approximately following roads or rail lines shall be respectively construed to follow the nearest right-of-way edge.

E. Shoreline buffers are regulated by SPMC 15.14.320 (Vegetative Conservation and Shoreline Buffers) and Section 4 of Appendix B (Critical Areas Regulations). [Ord. 580 Att. A § 3.2.6, 2019.]
