In addition to any other penalty or remedy available, any person, firm, or corporation violating any provision of this chapter, or who creates, keeps, maintains, or allows to remain any nuisance defined or designated herein shall be guilty of a misdemeanor and shall be punished by a fine in the amount not to exceed $1,000, incarceration for a period not exceeding 90 days, or both such fine and imprisonment. Upon a conviction, and pursuant to a prosecution motion, the court shall also order immediate action by the person, firm, corporation, or other legal entity to correct the condition constituting the violation and to maintain the corrected condition in compliance with this chapter. In addition, any person found guilty of violating this chapter shall pay all expenses incurred by the town in the enforcement of this chapter. Any act of a continuing nature as prohibited in this chapter shall be considered a separate offense for each day that the violation occurs. [Ord. 617 §§ 1, 2 (Exh. A), 2022.]
