A. The local administrator shall make interpretations where needed, as to exact location of the boundaries of the areas of special flood hazards (e.g., where there appears to be a conflict between a mapped boundary and actual field conditions). The local administrator shall make the decision on an interpretation without a public hearing.

B. In order to request an interpretation, the following information shall be submitted to the town:

1. The name, address, telephone number and email address of the applicant, a completed application form with the date of submission to the town and the applicable fee;

2. The identification of the code provision that is the subject of the applicant’s administrative interpretation, or the specific conflict alleged between the mapped boundary and actual field conditions, and why the applicant believes that there is a conflict;

3. A statement that the property subject to the interpretation is in the exclusive ownership of the applicant, or that the applicant has requested the interpretation with the consent of all owners of the property.

C. Criteria for Approval. The local administrator shall make the interpretation based on this chapter, documents adopted by reference in this chapter and the review of critical areas studies and independent third party verification, if needed.

D. Appeals. An appeal of the local administrator’s decision on an interpretation shall be filed within the deadline and under the procedure set forth in SPMC 17.09.070. [Ord. 556 § 2, 2017.]
