Article 8. Shoreline Permits, Procedures and Administration

The town of South Prairie (town) shall administer this SMP according to the following roles and responsibilities:

A. Shoreline Administrator. The shoreline administrator has overall administrative responsibility of this SMP. The shoreline administrator, or his or her designee, shall make administrative decisions and interpretations of the policies and regulations of this SMP and the Shoreline Management Act (Act).

The shoreline administrator is hereby vested with the authority to:

1. Administrate this SMP.

2. Grant or deny exemptions from shoreline substantial development permit requirements of this SMP per SPMC 15.14.580(C).

3. Authorize, approve, or deny shoreline substantial development permits, except for those for which the hearing examiner or local government legislative authority is the designated decision maker. The shoreline administrator shall also have the authority to grant or deny shoreline substantial development permits, time extensions to shoreline permits, revisions, shoreline variances, and shoreline conditional use permits under this SMP.

4. Make field inspections as needed and prepare or require reports on shoreline permit applications.

5. Make written recommendations to the South Prairie planning commission and/or town council.

6. Advise interested persons and prospective applicants as to the administrative procedures and related components of this SMP.

7. Collect fees for all necessary permits as provided in town ordinances or resolutions. The determination of which fees are required shall be made by the town.

8. Make administrative decisions and interpretations of the policies and regulations of this SMP and the Shoreline Management Act (Act).

B. State Environmental Policy Act (SEPA) Responsible Official. The SEPA responsible official or his or her designee is authorized to conduct environmental review of all use and development activities subject to this SMP, pursuant to Chapter 197-11 WAC and Chapter 43.21C RCW.

C. South Prairie Town Council. The South Prairie town council (town council) is vested with authority to:

1. Review the SMP as part of regular SMP updates consistent with RCW 90.58.080 and WAC 173-26-090 as a major element of the town’s planning and regulatory program.

2. Initiate an amendment to this SMP according to the procedures prescribed in WAC 173-26-100 and submit proposed amendments to this SMP to Ecology according to the procedures prescribed in WAC 173-26-110. The town may utilize the optional joint review process for SMP amendments according to the procedures prescribed in WAC 173-26-104.

3. Adopt all amendments to this SMP, after consideration of the recommendation of the town staff. Substantive amendments shall become effective 14 days from Ecology’s written notice of final action. [Ord. 580 Att. A § 7.1, 2019.]
