Article 7. Nonconforming Uses and Development Standards

A. For the purposes of this chapter, a nonconforming use, structure, or lot is defined as a nonresidential shoreline use or development which was lawfully constructed or established, but which does not conform to present regulations or standards of the SMP. These definitions apply solely to nonconforming structures, developments, uses, and lots in relation to the policies and regulations of this SMP. SPMC 15.04.020 contains separate definitions for “nonconforming uses,” “nonconforming buildings and structures,” “nonconforming lots” and “nonconforming signs” which apply to nonconformity in relation to SPMC 17.08.100.

B. Residential structures and appurtenant structures that were legally established prior to the effective date of the Act or this SMP and that are used for a conforming use shall be considered legally conforming and are not subject to the provisions of this chapter. For the purposes of this chapter, “appurtenant structures” shall mean garages, sheds, and other legally established structures. “Appurtenant structures” shall not include bulkheads and other shoreline modifications or over-water structures.
